Ministers liable for rape of girl, 5 (South Africa)

Cape Town – A 5-year-old girl was viciously raped by a man who should never have been released on bail, said a judge who blamed a prosecutor and a policeman.

The Weekend Argus reported that the ministers of justice and police were liable for damages following a court action that the girl’s mother brought against the ministers.

The girl’s rapist, Ockert Steyn, was serving six life sentences, two for the rape of the girl and other rapes.

At the time of his trial, the prosecutor did not reveal that Steyn had a criminal record for rape and breaking his parole conditions.

A statement by the victim that strengthened the State’s case was also not handed in to court.

A magistrate granted Steyn bail and police were informed three days later that he had breached his bail conditions.

But police did not arrest him and three weeks later, the 5-year-old girl was kidnapped and raped in an attack that severely injured her and led to her having to have surgery.

The mother was claiming R403 500 for herself and R1.6m on behalf of her daughter but the court had not yet determined what amount had to be paid out to them.
